 Carlstadt Mayor William Roseman

CARLSTADT (May 29, 2009, 9:35 a.m.) — Carlstadt Mayor William Roseman and his former spouse, Lori Lewin, are accused of stealing medical and prescription plan benefits from the borough over the last several years, according to the Bergen County Prosecutor’s Office.

A grand jury indicted the two on charges of third-degree conspiracy to commit theft by deception, third-degree theft by deception and second-degree official misconduct Friday, May 29.

If convicted, the two each face up to 10 years in prison for the official misconduct charge.

The Confidential Investigations Unit, a branch of the prosecutor’s office, began its investigation in January 2008, stated Bergen County Prosecutor John Molinelli. The investigation determined that Roseman and Lewin were divorced in July 2000, but the mayor failed to notify the borough’s benefit administrator, Insurance Design Administrators, within 60 days of the divorce, according to authorities. The state alleges that Roseman notified IDA in January 2008, more than seven years after his divorce.

Roseman is accused of keeping his ex-wife on the borough’s benefits plan during this time, while Lewin is accused of obtaining prescription benefits in excess of $7,000 from July 2000 to January 2008. She also apparently received medical benefits through 2003, the prosecutor’s office added.

Roseman is also accused of not notifying IDA of his change of address in 2001.

The state further alleges that as mayor of Carlstadt, Roseman presided over council meetings where funding for the borough’s medical and prescription plans was approved, while at the same time, Lewin was allowed to remain on the benefits plan.

The hot potato

In the immediate hours following the mayor’s indictment, Carlstadt officials went off the radar, choosing not to comment to the press without first learning of the accusations.
Immediate calls to Roseman were unanswered.

A conversation with Carlstadt Borough Administrator Jane Fontana on her cell phone continued until a reporter with The Leader mentioned the allegations. Then the line went dead.

Following this, repeated calls to Fontana’s office and cell phone numbers were left unanswered. A reporter with The Leader stopped by Fontana’s office and found the door closed Friday, May 29, in the late morning hours.

Carlstadt Borough Attorney John Jay Fahy did talk, saying he was surprised to hear of the indictment. “Mayor Roseman is a dear friend of mine and has been for over 15 years,” he said. “I do not believe he did anything illegal. ... My experience is that he is very honest and straightforward. I just don’t understand this.”

Fahy added that he knew Roseman and his wife were divorced, and that he believed most of her medical benefits were paid by her own medical insurance company. “Mayor Roseman has a child and his benefits are paid by the borough,” he added. “I think that’s where the confusion was.”

Fahy said that roughly one year ago, Carlstadt officials became aware of three other borough employees who were also receiving benefits for their ex-spouses. “They were getting complete benefits for their exs and dependents,” he said. “These people were not investigated and not charged. Some of them work in the police department. It’s very unfair the mayor was charged and they were not. ... Either they charge them all or none of them. All or none.”

The borough attorney added that there was a “glitch” in the audit procedure for health insurance, and the borough didn’t know that ex-spouses were continuing to receive health benefits. The insurance manager has since put in a new policy, he added.

‘An honest public servant’

Roseman’s attorney Ed Cillick also responded to queries from The Leader. “I am very disappointed that they decided to indict Willy,” he said. “He’s nothing but an honest public servant. He’s absolutely innocent. This involved a claim that his wife accepted medical benefits. ... He had no knowledge of.”

Cillick added that once Roseman found out about the benefits given to his wife, the mayor demanded an audit.

After looking into the matter, the audit found “many borough employees’ ex-spouses were still active. Two are police and one is a DPW worker. Their dependents were also receiving full benefits. Clearly this is nothing but a mistake. It’s disappointing.”

Cillick said Roseman would fight the charges “all the way.”

Roseman, a Republican and lifelong resident of Carlstadt, was re-elected in 2007. He has served for several years as Carlstadt’s mayor. Additionally, Roseman has served on the Carlstadt Volunteer Ambulance Corps and is a charter member of the Carlstadt Historical Society. He is also an honorary member of the Carlstadt

Fire Department. Roseman is the co-founder, vice president of finance and director of Xandros, Inc., according to the most recent information available to The Leader.

According to Carlstadt’s code of ethics, “No elected or appointed official, officer or employee of the borough shall improperly use his/her official position in order to obtain a personal discount or other benefit from any person whatsoever.”

Roseman and Lewin are expected to be arraigned at the end of the month.

What about the staff in Boro Hall who pay the premiums? (Score: 0)

This article doesn't account for the staff in Boro Hall who handled the paperwork and paid the premiums on behalf of all qualified insured. Administrator, payroll, Borough Clerk, and others all knew of mayor Roseman's marital status, domicile, and insurance coverage. Will any of those trusted and loyal employees be charged?

We should all be feeling lucky these folks work so hard for so little. A small stipend isn't much for what they do.
I'm all for our local volunteer politicians and family (Mayor Roseman has a son) getting health benefits. East Rutherford doesn't provide any benefits to our local Mayor and Council. That is a shame.

The Police Officers regularly receive discounts on things like dry cleaning. And these are the most well paid employees out there.

Talk about code of ethics. Not to mention they are always on the hand held mobile phones while driving. "Do as I say and not as I do?"

Hold up I voted for McCain even though he chose a Governor whose state's population was less than the folks in HACKENSACK NJ??? and this is what MY Republican Mayor did? This makes it absolutely clear that sticking to one political party and ignoring the corruption in it and looking at corruption in the other was selfish, short-sighted and narrow minded. I will be INDEPENDENT after this!!! I refuse to follow the millions of Americans out there who stick to either party as if it is a cult/religion... that will bring happiness ever after. THERE ARE CORRUPTED POLITICIANS ON BOTH PARTIES!!!

That's ridiculous. Everyone knew the mayor was divorced. He lived on a different street than his x-wife and I knew a girl he was dating. I may not be a supporter of his but I doubt he would take the chance of going to jail for his x-wife. What's the benefit to him?

This is why health benefits should not be extended to part-time elected officials. While their salaries are small, they are receving tens of thousands of dollars in medical reimbursements.

The same with pensions. Why should an elected official qualify for a pension?

This should be reserved for full-time employees only.

in fact all part-time workers should be exempt from receiving health benefits or a pension.

One-party government in Carlstadt allows people like Roseman to do what they want. Now he's ruined.

Unfortunately, he has no one to blame but himself.

What the prosecutor isn't saying is that when he got divorced, the Mayor filled out the paperwork to change everything. Chris Assenheimer forgot to change it. The prosector also forgot to mention that there wwere five other people who's former wives were on the insurance (three of them cops).

Everyone in the borough hall knew he was divorced and his paperwork confirms that. But nobodys mentioning that at all. They're just out to get him. It's that simple.

and this is the dumbest charge I have ever heard.

Ok folks we wanna place this game in this town,
then start following cops who sit around or stop home. Follow the dpw who these guys make huge salaries and work at best 4 hours a day!
Give me a break.
And as far as laying cops off, when you see their salaries it is a disgrace over a hundred grand a year! please. Bike Patrol, horses, cycles............this is Carlstadt.......what is next a swat team!

Now if the those employees who knowingly took medical benefits for their ex are accountable to pay back the town for all the years they have caused the taxpayers major $$$$ does that mean we wouldn't be looking at an increase in taxes???? Why not in this day and age when everyone has to contribute some dollars towards their medicals that borough employees don't. If you want to help the taxpayers then all employees should pay a few dollars towards their medical care. Taxpayers pockets have run dry.

It amazes me!

Carlstadt is the last republican stronghold in south Bergen county. Not only is the Prosecutor a democrat, but has anyone even mentioned the following:

Silvia Presto - the wife of the man Roseman beat works at the Prosecutor's office
Deana Cassire - the cousin of the man running against the republicans this year works at the Prosecutor's office

Why hasn't anyone mentioned that? Your telling me that doesn't play in this situation?

Nice... lets pick out innocent Carlstadt residents and draw attention to them to try and take the attention off of Roseman. Now that’s a political move!!

Stay on topic!! Roseman is being accused of stealing from the town... does it really matter who called him out on it? Does it make what he did any less wrong? The fact is that there was enough evidence against him to indict him, so there has to be something to this.

This isn't the first lawsuit against Willie. A couple of years back he was sued for fraudulent deception in obtaining funds or something like that. Anyone else remember this? Something to do with his company Xandros, Inc.

It looks like deception is his M.O... he has deceived a lot of people in town.

I am so weary of people reacting instead of thinking. Has anyone out there heard all the "facts"? Whatever happened to be innocent until tried and convicted. And, I must agree with someone's comment that it is politically motivated. Let's use some common sense; patience.

There are a number of things in this town I do not like BUT I would not trade this Mayor for our past mayor....if anyone should stand before a jury.... or has everyone forgotten!

I know most people are angry about the state of the nation; the cost of food & lodging, fear of job loss or already anxious over where they will get the money to survive; but, please, let's not vent our rage over something until we are l00% certain.

I am a democrat and that's not going to change. But I also read the indictment and there are a few things that I don't understand.

Firstly, I don't see any financial benefit to Mayor Roseman. This was his ex wife, not his daughter or aunt or cousin where he would have an interest in helping them. Either way, no one is saying that he received anything. If what the papers say is true, his ex wife was responsible for her own insurance according to the divorce so why would he want to give her health insurance?

Secondly, I read in the paper that he was one of seven people that this happened to in the borough. Was it a conspiracy of everyone? It seems to me that the insurance administrator should be held accountable. Your not talking about just one person here. Someone is not doing their job.

Thirdly, and as someone has said earlier, I've never known anyone to be indicted for not changing their address. That's a little far fetched.

Fourthly, the papers said that when Roseman found out, he required all to pay it back and they did. Why aren't those people being prosecuted. Three cops? I don't understand that one.

I don't know Mayor Rossman well and this is something that should not have happened but I can't see where he's thief..

One more comment. I remember when we had flooding on 10th Street he was the only one to come down to help us and he was with my neighbor for over four hours. He even helped her clean her basement. that doesn't mean what happened shouldn't have happened but it doesn't mean that he does care for his people.

I heard Dave Hollenbeck say he went to the prosecutors office about this so please don't tell me that politics is not involved. I heard it come straight from his mouth. You can't tell me otherwise because I heard it myself!

In fact, Dave was boasting that he did it. And he mentioned the Cassara girl at the prosecutors office as well.

I typically don't write in these blogs but after reading what's being said, I had to say something. Especially when I read that Cassars's cousin is running as a democrat this year. Everyone knows that Dalton is her cousin.

If it is true that the ex spouses of town employees were also receiving benefits, then there MUST be an investigation - along with the mayor. Are we that stupid to believe that NO one in the town - and this includes the borough attorney - did not know that the ex spouses were receiving benefits????...the attorney practically admitted that he knew....but I guess if NO one was going to blow the whistle, why shoudl he...Well, the taxpayers should be angry as hell, and demand that all of these people, along with the attorney and town administrators, be reprimanded...if NOT discharged. Their allegiance should be to the town...NOT the individual.

I just spoke to someone that was at the Little League and they also said that Hollenbeck is behind this.

They said the mayor was there also and people were waiting in line to talk to him. I suppose not everyone is mad at him or at least people must believe him. Either way, he's not hiding.

I really don't know him other then to say hello but most people I talk to say that this is politics and they are just out to get him. I do know someone that knows him well and she told me that he is an honest man and tires to help people. I didn't grow up here so I'm not a native and don't know as much as the people that have always live d here.

It's too bad that Buddy Davis, a cop that couldn't do his job, comes out and attacks the Democrats because Roseman got busted. He comes out and blames everyone else for his screw ups. Face it Buddy......You're a loser. Stay were you belong. In the hole that you dug for yourself. You should've helped that guy that was getting his butt kicked at the diner but you decided to turn around and walk away. That's way you're a jerk. You're nothing. Stay away from this and focus on a family intervention. Get a life.

Goofball Roseman was supposed to be a role model for younger children and teens. Whenever something goes wrong he either blames on the new giants stadium, Zanudo, or says " I didn't know". You knew this BEFORE he was elected.....so why would you vote for him?? I just want to tell him......GET A NEW HOBBY!!!!

You know what???? There are good decent people that live in Carlstadt. Except for one. Buddy Davis. There was a situation in a diner were a young person was getting his butt kicked, and Buddy was there and looked the whole picture and said "I'm off duty" and walked away. Needless to say....this spineless bastard still walks the streets and has a penchent against the Democrats in town. He's the one that probably alerted the Prosecutors Office about Roseman and blamed the the Democrats. He's been a jerk and still is a JERK. It's all about him.

I was in the store today and people were talking about Hollenbeck telling everybody that he went to the DA about Roseman. One of the guys there was a cop and he said that Roseman didn't do anything and that the democrats are just trying to sink the republicans. He said that the county doesn't like Roseman because he won't hire the democrats son at the boro hall. I left after I got my sandwich.

The more I hear about this, the more I think that this is politics. Why should Roeman hire the democrats son. That's a tall price to pay. Bet he wished he hired him now. :-)

I can't believe what I'm hearing about Willy Roseman. I know him for 23 years and I've never known him to do anything for himself. He is always putting others ahead of himself. Even the head of the Democrat Party told me that Willys not a thief and I agree.

You may not like him or you may want someone instead of him to by mayor but one things for sure, the man in not a crook.

Roseman gives his salary away to poor people - does that sound like someone that would steal money for his former wife? Really people, you are all talking about someone that you don't even know. When I hear someone using the term "jerkoff", that tells me that no matter what Roseman does, they won't like him. I read that Willy said that he doesn't see who is on the insurance. I believe that. Where I work, I handle the insurance and I am the only one to see who's on. Not even my boss sees it. That's the rules governing insurance confidenitality.

Typically one person handles the insurance and that person is the only one that can see who is on and who is not. It dosent surprise me to hear that Willy did not see the insurance. If he did, I would be questioning that.

I'm a democrat and I live in Carlstadt. I am also a democrat and I don't that that Will Roseman is a thief.

Everyone I talk to seems to come to the same conclusion and fellow democrats agreed with me. I do want to know how something like this can happen and that doesn't make me very comfortable to know that 6 other people's wives were also on the insurance. Someone isn't doing thier job and that's what needs looking into.

I knew Hollenbeck was involved and it was political. Sure the mayor's wife shouldn't have been on the town policy but Hollenbeck said it himself, he didn't know because of Hipa laws and the mayor wouldn't know it also.

I know the mayor and I know he would not take money from the town. He has more money than he knows what to do with. Anyway, it's what money would he make on having his former wife on the town's policy?
